Welcome to Shipmend.

These Terms & Conditions ("Terms") govern your access to and use of the Shipmend mobile application, website, and related services.

By creating an account or using Shipmend, you agree to these Terms. If you do not agree, you should not use our platform.

1. About Shipmend

Shipmend Technologies Ltd ("Shipmend", "we", "our", or "us") operates a peer-to-peer technology platform that connects travellers with individuals or businesses who wish to send parcels.

Shipmend is not a courier company, transport company, freight forwarder, or employer of travellers. We provide technology that facilitates connections between users.

2. Eligibility

To use Shipmend, you must:

• Be at least 18 years old.
• Provide accurate registration information.
• Complete any required identity verification.
• Agree to comply with these Terms.

Shipmend may suspend or terminate accounts that do not meet these requirements.

3. User Accounts

Users are responsible for:

• Maintaining accurate account information.
• Keeping login credentials secure.
• Protecting their passwords and verification codes.
• Promptly reporting unauthorized access.

You are responsible for activities carried out through your account.

4. How Shipmend Works

Users may register as:

• Travellers
• Parcel Senders
• Or both.

Shipmend matches travellers and senders based on information such as travel route, destination, timing, and parcel requirements.

Shipmend does not guarantee that every request will receive a match.

5. Identity Verification

Shipmend may require identity verification before allowing access to certain features.

Verification may include:

• National Identification Number (NIN)
• Government-issued ID
• Selfie verification
• Additional documents where necessary

Providing false information may result in immediate suspension or permanent removal.

6. User Responsibilities

Senders agree to:

• Accurately describe every parcel.
• Ensure parcels comply with applicable laws.
• Properly package items.
• Disclose fragile or sensitive contents.
• Deliver parcels to the agreed meeting point.

Travellers agree to:

• Transport parcels responsibly.
• Inspect parcels before accepting them.
• Refuse suspicious or prohibited items.
• Follow agreed delivery arrangements.
• Comply with applicable laws during transportation.

7. Prohibited Items

The following items are strictly prohibited:

• Illegal drugs
• Firearms
• Ammunition
• Explosives
• Counterfeit goods
• Stolen property
• Hazardous chemicals
• Human organs
• Wildlife products traded illegally
• Any item prohibited by law

Users are solely responsible for the legality of items they send or transport.

Shipmend reserves the right to suspend or terminate accounts involved in prohibited activities.

8. Fees and Payments

Shipmend may charge platform service fees.

Applicable fees will be displayed before a transaction is confirmed.

Users are responsible for any taxes or charges required under applicable laws.

9. Cancellations

Users may cancel transactions subject to Shipmend's Cancellation Policy.

Repeated cancellations may affect account ratings or result in restrictions.

10. Ratings and Reviews

Users may rate one another after completed transactions.

Ratings must be:

• Honest
• Respectful
• Relevant

Shipmend may remove reviews that violate these Terms.

11. Safety

Users are encouraged to:

• Meet in safe public locations.
• Verify identities before exchanging parcels.
• Inspect parcels before transportation.
• Report suspicious behaviour immediately.

Shipmend may investigate reports of misconduct.

12. Disputes Between Users

Shipmend may assist in facilitating communication during disputes.

However, Shipmend is not responsible for resolving every disagreement or guaranteeing a particular outcome.

Where appropriate, users may be required to cooperate with investigations.

13. Platform Availability

While we strive to provide uninterrupted service, Shipmend does not guarantee continuous availability.

Services may occasionally be unavailable due to maintenance, technical issues, or circumstances beyond our control.

14. Intellectual Property

All rights relating to:

• Shipmend
• Our logo
• Branding
• Software
• Website
• Mobile application
• Content

remain the exclusive property of Shipmend Technologies Ltd unless otherwise stated.

Users may not copy, modify, distribute, reverse engineer, or reproduce our intellectual property without written permission.

15. Privacy

Your use of Shipmend is also governed by our Privacy Policy.

By using Shipmend, you consent to the collection and use of information as described in that policy.

16. Account Suspension and Termination

Shipmend may suspend or permanently terminate accounts involved in:

• Fraud
• Fake registrations
• Identity theft
• Repeated cancellations
• Abuse of other users
• Misrepresentation
• Illegal activities
• Violation of these Terms

Shipmend's decision regarding account suspension may be subject to internal review where appropriate.

17. Limitation of Liability

Shipmend provides a technology platform to connect users.

To the maximum extent permitted by law, Shipmend is not liable for:

• Acts or omissions of users.
• Loss or damage arising from user-to-user transactions.
• Delays caused by travellers.
• Events beyond our reasonable control.

Nothing in these Terms excludes liability where it cannot lawfully be excluded.

18. Indemnity

You agree to indemnify and hold Shipmend harmless from claims, losses, damages, liabilities, and reasonable costs arising from:

• Your misuse of the platform.
• Your violation of these Terms.
• Your unlawful conduct.
• Your infringement of another person's rights.

19. Changes to the Platform

Shipmend may introduce, modify, suspend, or discontinue features or services at any time.

Where practical, users will be informed of significant changes.

20. Changes to these Terms

We may update these Terms from time to time.

Updated Terms become effective when published on the platform.

Continued use of Shipmend after changes take effect constitutes acceptance of the updated Terms.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.

Any disputes shall be subject to the jurisdiction of the competent courts of Nigeria, unless otherwise required by applicable law.
